Wayne PD: Stoned Driver Outside Route 23 Fast-Food Joint Resisted Arrest

WAYNE, N.J. -- "I have to go," a stoned driver told Wayne police who found him slumped over the wheel of his car outside a Route 23 fast food restaurant, authorities said.

Officers Mark Ciavirella and Mike Polifrone smelled the odor of burnt pot inside the 2007 Honda Accord parked outside the Taco Bell as soon as the driver rolled down his window Wednesday afternoon, Capt. Laurence Martin said.

Carlos Rufino, 21, of Wayne, "appeared dazed and stated 'I have to go' and attempted to leave," Martin said.

Polifrone reached inside and removed the keys, after which Rufino raised the window, pinning his arm, the captain said.

The officer then reached down and unlocked the door, he said.

Rufino, whose eyes were bloodshot and watery, "continued to be uncooperative" after the officers got him out of the car, Martin said. He also reeked of marijuana, Martin said.

A search this yielded two cigar roaches filled with pot in the cup holder and a ziplocking bag of marijuana, he said.

Rufino was taken into custody and later released on a summons for an appearance in Superior Court on various drug charges, as well as hindering apprehension and driving while on the suspended list, Martin said.

Last week, authorities said two Wayne police officers on routine patrol found a Sussex County fugitive and his companion parked outside the same Taco Bell with 77 bags of heroin in their car.
